Eviction filed for DHRL: All Seasons Resorts Expands into Santa Fe, San Diego and Mesquite

Eviction filed for DHRL

On Aug. 12, The Park Record reported that the homeowner association for The Lodge at Mountain Village was in a disagreement with David Holland Resort Lodging (DHRL) over the nightly-rental company's occupation of common areas in the facility. On Aug. 14, the association filed in Third District Court for an eviction of Crossways Corporation, the parent company of David Holland, on the grounds that it owed the association around $80,000.
On Friday, association president Tom Mccausland said the move is part of a larger process of transitioning the management of hotel services at The Lodge from DHRL to All Seasons Resort Lodging, the company the association has chosen.
This transition is leaving the door open to rumors and speculations as to what will become of DHRL employees, and DHRL itself without spaces in which to operate.
Alan Finnegan, owner of All Seasons, said Friday that as part of the transition they will be interviewing candidates to help staff the new operation. He said he welcomes terminated DHRL employees to apply. He said he was not in a position to comment on the future of DHRL.
The company said it did not have a comment at this time because clients needed to be informed of all developments before it makes a public statement. An employee close to David Zatz, owner of DHRL, said those developments have been changing daily.
The move toward the eviction filing began earlier this month when the company argued that it held enough nightly rental contracts with condo owners to justify its occupation of meeting and waiting rooms, a bellhop counter, a laundry facility, storage closets and other commons areas. The association said that it did not, and that it was default on owed monies.
Attorney for the association, Jonathan G. Brinton, said he still isn't sure how many actual contracts the company has with owners, but that he is confident they lack the critical mass to continue occupying the spaces in light of the money owed.
The $80,000 includes legal fees, triple damages on specific fines, late fees and other expenses added to the original amount, he said.
If DHRL ignores or complies with the eviction request, an order of restitution could be obtained by late next week or early the following week, he said. At that point, all the spaces can be legally cleared so the new hotel management firm can move in and prepare for ski season.
If DHRL contests with the request, resolution of the issue could take up to 60 days, he predicted.
DHRL left its main offices at 1415 Lowell Ave the farthest north office space on the patio of the Resort Center last month. That space is owned by Trent Davis with Resort Commercial Property Management.
Currently Nick Caravaglia, president of DHRL, has left his regular offices down the hall from the Lake Placid Room and is now occupying one of the contested spaces as an office off the first level of underground parking.
Tom Mccausland, president of the homeowner's association, said DHRL property is still in various storage areas, its employees are still using the laundry room and the company holds keys to the meeting rooms. The company's accounting and reservations staff are also occupying contested areas, he said.
The front desk area for The Lodge is owned by Davis but staffed by DHRL employees.
Despite troubles between companies, Mccausland said he believes all of the individuals involved are working toward a smooth transition. Alan Finnegan, owner of All Seasons, said Thursday that his company's sole involvement in the situation is taking over the management role at a later date determined by the association.
